MEMORANDAM OF ASSOCIATION
1) Name of the Association: NATIONAL ASSOCIATION OF PHYSICAL
EDUCATION AND SPORTS SCIENCES (NAPESS)

  2. THE AIMS AND OBJECTIVES:
  3. To closely monitor the professional growth and development of Physical Education in India.
  4. To provide a platform for a greater interaction among physical education personnel.
  5. To bring into the profession the latest knowhow; based on results of applied research through scientific and technological intervention.
  6. To counsel the Government and other agencies on the need to assign appropriate status to physical education; thus, elevating the status of profession and the personnel.
  7. To encourage outstanding physical educationists by recognizing their contributions to the profession.
  8. To help in promoting the health of the citizens in general and in achieving excellence in sports in particular; through physical education and sports sciences.
  9. To cooperate, Coordinate and to collaborate with peer   professional organizations both in India and abroad.
  10. To convene the meetings of professional experts, educators and other peer groups for the promotion of Physical Education and Sports Sciences.
  11. To initiate, undertake, promote and coordinate research in all the areas of   Physical Education and Sports Sciences.
  12. To engage in all such endeavors that would create greater awareness of   Physical Education and Sports sciences.
  13. To help sportspersons in achieving excellence in their performances.
  14.  To organize seminars, symposia, workshops, conferences, orientation/ exposure/refresher courses for the benefit of the members and upgrading the standards of physical education and sports sciences in India.
  15. To publish Newsletters, Bulletins, Handouts, Pamphlets and Journals pertaining to Physical Education and Sports sciences.
  16. To help in the establishment and in maintenance of a National Library

And Achieves.

  1. To collect, compile and compute relevant inputs concerning Physical Education and Sports Sciences and to help in the dissemination of information through audio-visual mechanics of informatics.
  2. To help in the production of Textual literature in English, Hindi and/or ,other regional languages in Physical Education, Recreation and sports sciences
  3.  To widen the avenues of Physical education, Sports sciences and wellness through Diversification of Curricular content for employability and excellence.
  4. To guide and assist in the promotion of General Physical Fitness among the populace through physical Education and Sports Sciences.
  5.  The benefits of this association will be open to all citizens irrespective of their cast, creed, ethnicity, region or language.

CERTIFICATE

  1. Certified that the Association is formed with no profit motive and that no commercial activities are involved in its working.
  2. Certified that the Association would not engage in any agitations and trade union activities ventilate grievances.
  3. Certified that the Office bearers are not paid any remuneration or honorarium from the funds of the Association without the return permission from the president  and sectary

3.Jurisdiction

 

1) MEMBERSHIP:

  1. Those working professionals in Physical Education and Sports Sciences viz. Physical Educators, Coaches and Sports Administrators, residing in India and desirous of voluntarily becoming a member of the Association; while abiding the Rules and Regulations of the Association on payment of prescribed registration fee of Rs.3000/- are eligible to become life members.
  1. MEMBERSHIP OF ASSOCIATIONS/PROFESSIONAL BODIES:

 Any professional body/Association/organization/institution, voluntarily willing to be abided by the rules and regulations of the NAPESS is eligible to become a associate member by paying membership fee of Rs.25, 000/- without voting right.

  1. OVERSEAS MEMBERS:

Any foreigner working in the field of Physical Education, Sports Sciences, Sports Coaching and Administration is eligible to become associate  member of the Association by paying a sum of US $ 200 along with an undertaking to abide by the rules and regulations of the NAPESS without voting rights.

  1. HONORARY MEMBERSHIP:

The Executive Committee is empowered to invite highly accomplished sportspersons of the country to be the Honorary Member of the Association. Such members will have no voting rights and right to become an Executive committee Member or office bearer of the Association.
Note: (both overseas and honorary members will remain as the members without voting powers.)

  1. TERMINATION OF MEMBERSHIP:
  2. By Death or by virtue of the resignation by the member tendered in written.
  3. Any anti association activity of the member/ members if proved is liable for disciplinary action as decided by the executive committee.

2) MEETINGS:

  1. GENERAL BODY:

The Association shall convening a General Body Meeting once in a year as decided by the executive - preferably in the month of APRIL or at the convenience of the members. All the matters connected with the programmes of the Association shall be discussed and decided at such meeting through the website and email, 1/5 of the total existence members shall be the quorum of the general body and if the quorum is not sufficient at annual general body meeting the president can adjure and reconvene the meeting after  30 minutes the president and secretary shall preside over all the meeting of the association, the secretary shall present the annual report of the association in the annual general body meeting.
The election of the Office Bearers shall also be conducted during the meeting. The quorum of this meeting shall be the members present at the meeting in response to the meeting notice circulated 21 days prior to the scheduled meeting.

  1. EXECUTIVE COMMITTEE:

The Executive Committee Meeting shall be convened once in every six months or three times in a year giving at least 3 days advance notice to members of the Executive Committee. For any emergency purpose 24 hours prior written or telephone notice shall be given for convening the Executive Committee Meeting. The Executive Committee Meeting shall be convened by the 'A Members of the Executive by themselves may convene the meetings. The quorum for such meeting shall be 1/3 of the Executive Body and in the absence of 1/3 members, the meeting shall be conducted with the members present at the venue — after a gap of THIRTY minutes of the scheduled time of the meeting.

  1. SPECIAL/EXTRAORDINARY MEETING:

On special cause being shown, the Association or 1/5th members of the total members can call for special or extraordinary General Body Meeting by a written notice 10 days in advance. All such notices shall he served to all the members as far as possible mentioning the purposes or purpose for which the meeting is called for. Only the business specified in the notice shall be conducted in the meeting subject to the provisions of the section 12 of the Association Registration Act. The quorum of the meeting shall be 1/5th of the members on the rolls.

3)     EXECUTIVE COMMITTEE (OR) GOVERNING BODY:
The Executive Committee shall consist of a President, Sr. vice-President, 4 Vice-              presidents, One Secretary, one Joint Secretary, one Treasurer and 16 Executive Members in total. Such Committee will hold the office for a 'period of FOUR YEARS.

4) POWERS OF THE GENERAL BODY:

  1. PRESIDENT:

The President shall preside over all the meeting of the association and conduct eh proceedings. The presidents have the power of giving the casting vote.  Whenever tie occurs over a resolution. if the quorum is not sufficient in executive committee or annual general body meetings, president can adjourned and reconvened meetings after 30 minutes.

  1. Sr .VICE-PRESIDENT:

The Senior Vice-President shall exercise all the powers of the President in his / her absence and when such powers have been delegated to him in writing.

  1. SECRETARY:

To convene all the meetings of the association, and prepare the Agenda in consultation with the President. The Secretary shall perform correspondence in all matters of the Association. The Secretary shall also be responsible for the efficient running of the Association as per the bylaws. The secretary shall be custodian of all the recodes of the association. The secretary in consultation with treasurer shall update the list of new members and bring to the notice of the executive committee. The secretary shall publish name and address all the member of the association in the website/ association journal before general body meeting. Secretary shall have power of holding Rs.10000/- for Contingency.

  1. JOINT SECRETARY: .

In the absence of the Secretary the Joint Secretary shall act as Secretary and perform his/her duties.

  1. TREASURER:

The Treasurer shall be the custodian of the cash and accounts and shall be responsible for placing the accounts before the General Body Metering. The Treasurer shall collect Membership Fee, Subscriptions, Donations from the Members and Public and give proper receipt to them. The treasurer shall sign and acknowledge all vouchers/receipts and payments on behalf of the Association. Treasurer shall also have powers operate the accounts jointly along with the president/secretary of the Association in Nationalized/ scheduled ‘Band(s). Treasurer shall be responsible to get the accounts duly audited by a certified charted accountant and present it in the executive council followed by the annual general body meeting.
Further the treasurer shall submit to same to the office of the register of societies to get the renewal from time to time.

  1.  EXECUTIVE MEMBERS:

the executive members shall be present in all the meeting s and shall assist the association in smooth conduct of the deliberation of the association, if any member is absent in consecutive three meetings without appropriate reason he/she shall ceases to be member.
g) GENERAL BODY MEETING AND ELECTION OF OFFICE BEARERS:

  1. Notice of the General Body Meeting specifying the purpose shall he sent to the members twenty one (21) days in advance of the scheduled date, and there is no need of definite quorum for the purposes of the election regarding matters.
  2. Election for the posts of President and Secretary shall be conducted during the General Body Meeting once in every four years following the prescribed procedures. However no member can hold the position of president or secretary for more than two terms. These including office bearers.
  3. President in consultation with the Secretary, shall nominate the other office bearers and 16 (sixteen) executive Members; giving due importance to all regions of the country.

The term of the Office Bearers is for the period of four years.

5. AUDIT OF ACCOUNTS:

The accounts of the association on every finical year shall be placed before the Annual general body meeting duly audited by a chartered accountant appointed by the executive committee of the association is mandatory.

6. LEGAL MATTERS:

The Association may sue or be sued in the name of the name of the secretary in his/her jurisdiction only. Legal advisor(s) shall be appointed by the executive committee from time to time and their remuneration fixed, as and when required.

7. QUORUM:

The Quorum of regular General Body Meetings shall be 1/5th of the Members on rolls. If there is no quorum, the president have powers to adjourn the meeting and reconvened the same after half an hour.

8. FUNDS:

The Funds of the Association shall be utilized for the welfare activities of the Association. Fund raising shall be by way of donations from the public, from both State and Central government body’s. A joint account should be opened in any nationalized bank or a scheduled bank in the name of the Association which will be the operated jointly by the name of the   president / sectary and the Treasurer — who are empowered to do bank transactions i.e. to deposit and withdraw on behalf of the Association.

9) INCOME TAX ACT 1961:

  1. The funds of the Association would be invested as per Section 11(5) of the IT Act, 1961
  2. The Association is irrevocable.
  3. The accounts would be maintained regularly and would be audited by a Chartered Accountant.
  4. The funds of the Association would be utilized only towards the objects and to no portion of it would be distributed in any manner to the Trustees or persons defined in Section 12 (1) (d) of the I.T. Act,1961.
  5. In case of winding up / dissolution, the net funds would be transferred to other institution having similar objects and enjoying exemption U/S 12A and 80-G of I.T. Act, 1961.
  6.  The benefits of the objects would be available to the General Public irrespective of Caste, Creed, Religion or sex etc.,.
  7. The charitable activities would be confined to the territory of India.
  8. He activities would be purely charitable / non religious in nature and not motivated for profit.

10) ENFORCEMENT OF JUDGEMENT:
The enforcement of Judgment against the Assets of the Association shall be in                        accordance with the provisions of Section 27 of A.P. Societies Registration Act 35 of 2001 followed.

11) DISSOLUTIONS:
In the event of the Association is dissolved the provision of Section 24 of A.P. Societies Registration Act 35 of 2001 is followed.

12) SAVING CLASS:
If the Association wishes to alter, amended, additions deletions to the bylaws of the association the executive committee shall appoint a subcommittee whose recommendations will be presented to the executive and annual general body for approval. From time to time

13) OTHERS:
If any other things done or any action taken under the said Acts in the exercise of any
power conferred by or under the said Acts shall be deemed to have been done or taken in the exercise of the powers conferred by or under who’s legal jurisdiction association function.
